1. Acceptance of Terms

By accessing or using the WebCreative website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.

WebCreative provides digital services including but not limited to:

  • Website design and development
  • AI-powered automation solutions (chatbots, lead capture, automated follow-ups)
  • Website upgrades and optimisation
  • Consultation and digital strategy services

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without prior notice.

3. Client Responsibilities

When engaging our Services, you agree to:

  • Provide accurate, complete, and current information as requested
  • Respond to our communications in a timely manner
  • Provide necessary assets, content, and approvals required to complete projects
  • Ensure you have the legal right to use any content, images, or materials you provide to us
  • Review deliverables and provide feedback within agreed timeframes

4. Intellectual Property

Our Work: Until full payment is received, all designs, code, and materials created by WebCreative remain our intellectual property. Upon full payment, ownership of the final deliverables transfers to you, unless otherwise agreed in writing.

Your Content: You retain all rights to content, logos, images, and other materials you provide to us. You grant us a limited licence to use these materials solely for the purpose of delivering our Services.

Third-Party Assets: Where third-party assets (stock images, plugins, fonts) are used, their respective licences govern their use. We will inform you of any such licences and associated costs.

5. Payment Terms

  • Project fees will be outlined in a written proposal or agreement before work begins
  • A deposit is typically required before project commencement
  • Payment schedules and milestones will be agreed upon in advance
  • Late payments may incur interest charges or project delays
  • All fees are exclusive of applicable taxes unless stated otherwise

6. Revisions and Scope

The scope of work, including the number of revision rounds, will be defined in your project agreement. Additional work outside the agreed scope may incur extra charges. We will always seek your approval before undertaking chargeable additional work.

7. Project Timeline

We will provide estimated timelines at the start of each project. Timelines are dependent on timely client feedback, content provision, and approval. Delays caused by the client may result in adjusted delivery dates.

8. Confidentiality

We respect the confidentiality of your business information. Any sensitive information shared during our engagement will be treated as confidential and will not be disclosed to third parties except as required to deliver the Services or by law.

9. Limitation of Liability

To the maximum extent permitted by law, WebCreative shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Services.

Our total liability for any claim arising from our Services shall not exceed the total amount paid by you for the specific project or service giving rise to the claim.

We do not guarantee that our Services will be uninterrupted, error-free, or secure. We are not responsible for any loss of data, revenue, or business opportunities.

10. Termination

Either party may terminate the engagement with written notice. Upon termination:

  • You will pay for all work completed up to the termination date
  • We will deliver all completed work and return your materials
  • Any deposits or prepayments are non-refundable unless otherwise agreed

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
